By creating an account or using WantSmith ("the Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms form a binding agreement between you and WantSmith ("we," "us," or "our"), operated by Keith Hurd in the state of Maryland.
We may update these Terms from time to time. When we do, we'll notify you by email or through the Platform. Continued use after changes take effect means you accept the updated Terms.
WantSmith is an online marketplace that connects buyers who need handcrafted goods or services ("Wants") with verified independent makers who bid on and fulfill those requests. WantSmith is a platform — we are not a party to any transaction between buyers and makers, and we do not manufacture, sell, resell, or deliver any goods or services ourselves.
You must be at least 18 years old to use WantSmith. By creating an account you confirm that you are 18 or older and that all information you provide is accurate and complete. We reserve the right to terminate accounts that we believe are held by minors or that contain false information.
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at keith@wantsmith.com if you believe your account has been compromised.
You may not create more than one account per person. You may not transfer your account to another person.
When you post a Want, you are describing a custom good or service you are seeking from a verified maker. Your Want must be:
We reserve the right to remove any Want at our discretion without notice.
When you accept a bid, you are entering into a direct agreement with that maker. WantSmith is not a party to that agreement. You are responsible for:
If a transaction goes wrong, your first step is to contact the maker directly through the WantSmith messaging system. If you cannot resolve the dispute, you may contact us at keith@wantsmith.com and we will do our best to help. However, WantSmith has no obligation to mediate disputes and makes no guarantee of resolution.
All makers must be verified by WantSmith before placing bids. Verification is at our sole discretion. We may approve, reject, or revoke verification at any time and for any reason, including but not limited to:

WantSmith is a handcraft marketplace. As a maker you agree that:
When you place a bid, you are making a binding offer to complete the described work at the price and timeline you specify. Placing frivolous, inaccurate, or misleading bids is a violation of these Terms.
When a buyer accepts your bid, you are entering into a direct agreement with that buyer. You are responsible for:
You retain full ownership of everything you make. By listing on WantSmith, you grant us a limited, non-exclusive license to display images and descriptions of your work for promotional purposes. We will never claim ownership of anything you create.
Currently, payment arrangements are made directly between buyers and makers outside the platform. WantSmith is not responsible for payment disputes, non-payment, chargebacks, or fraud between parties.
When platform payments are introduced, separate payment terms will apply and will be provided at that time.
WantSmith may charge a transaction fee on completed jobs in the future. We will provide clear notice of any fees before they take effect. Using the platform during a beta period does not create any expectation of permanent fee-free access.

You are responsible for all content you post on WantSmith, including want descriptions, bids, messages, profile information, and portfolio images. By posting content you confirm that:
You grant WantSmith a non-exclusive, worldwide, royalty-free license to display and use your content for the purpose of operating and promoting the platform.
We may remove any content at our discretion without notice.
Your privacy matters to us. We collect information you provide when signing up and using the platform, including your name, email address, and profile information. We use this information to operate the platform, send notifications related to your activity, and improve the service.
We do not sell your personal information to third parties.
We use Supabase to store your data and Resend to deliver email notifications. By using WantSmith you acknowledge that your data is processed by these third-party services in accordance with their own privacy policies.
You may request deletion of your account and associated data by contacting us at keith@wantsmith.com.
WantSmith is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the quality, safety, legality, or accuracy of any goods or services listed on the platform.
To the maximum extent permitted by law, WantSmith and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:
Our total liability to you for any claim arising from your use of WantSmith shall not exceed the greater of $100 or the fees you paid to WantSmith in the three months prior to the claim.
You agree to indemnify and hold harmless WantSmith and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time by contacting us at keith@wantsmith.com. Upon termination, your right to use the platform ends immediately.
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of WantSmith shall be resolved in the courts of Maryland.
If you have a dispute with another user, WantSmith is not obligated to intervene. However, we encourage users to reach out to us and we will do our best to help.
These Terms constitute the entire agreement between you and WantSmith regarding the platform. They supersede any prior agreements or understandings, whether written or oral.
